Is CE marking of a boat obligatory?
Yes, for putting it onto the market in the European Community, CE Marking is obligatory. The philosophy behind the new community directive approach is based on the free circulation of goods, as well as people and services. For this reason, no Country on the European Union may now prevent a CE marked product from entering its territory, not may it refuse to allow it to be marketed.
Is cooperation with a notified body mandatory?
For boats over 12 m in length (LH) in design categories A, B, and C, this is mandatory.
For boats under 12 m in length or in design category D up to 24 m, cooperation with a notified body is voluntary for the manufacturer.
Please note that you are always obligated to comply with all requirements of Directive 2013/53/EU on product safety, regardless of whether you have this assessed by a notified body.
For the import of used boats into the EU, cooperation with a notified body is always mandatory. In this case, the notified body must carry out a PCA.
This is also the only legal way for boats already in the EU, but no longer have valid documents (declaration of conformity), to obtain new, valid boat documents.
Does the CE Marking have an expiry date?
No, provided no modifications are made to the unit in question, the Marking has no expiry date. However, it may be necessary to have the Marking updated, if the Reference Standards change.
